A regulatory opinion is a structured legal analysis with a conclusion, not a generic memo. It translates the
system’s technical reality into a compliance position that third parties can evaluate.
Key characteristics
- Defined scope (product, markets, user groups, data categories, deployment model).
- Explicit assumptions and a fact base (what is known vs. what is unknown).
- Applicable legal layers mapped to the actual AI workflow (inputs → processing → outputs).
- Conditions / controls required for permissibility (governance, documentation, disclosures, contracts).
- Residual risks and “no-go” lines (where legal exposure becomes hard to defend).
Why it differs from “compliance statements”
- It is evidence-driven (documentation, logs, policies, technical measures), not slogan-driven.
- It is jurisdiction-aware (conflicting regimes are identified and managed, not ignored).
- It is decision-oriented (what can be launched now, what requires changes, what must be restricted).
